Montana Department of Revenue resolves an issue that has plagued our First Amendment jurisprudence for over 100 years: so-called “Blaine Amendments” that discriminate against religious schools. * Ala. Const. art. I, § 263: "School funds not to be used for support of sectarian or denominational schools. No money raised for the support of the public schools shall be appropriated to or used for the support of any sectarian or denominational school."

* Alaska Const. art. VII, § 1: "The legislature shall by general law establish and maintain a system of public schools open to all children of the State, and may provide for other public educational institutions. Schools and institutions so established shall be free from sectarian control. No money shall be paid from public funds for the direct benefit of any religious or other private educational institution."

* Wyo. Const. art. I, § 19: "Appropriations for sectarian or religious societies or institutions prohibited. No money of the state shall ever be given or appropriated to any sectarian or religious society or institution."

* Wyo. Const. art. VII, § 8: "Provision shall be made by general law for the equitable allocation of such income among all school districts in the state.
